I. INTRODUCTORY PROVISIONS

1. These General Terms and Conditions (hereinafter: GTC) primarily define the legal relationships between TICAT Kft. (hereinafter: Service Provider), which operates the ticket sales system, and the natural or legal person (hereinafter: Ticket Purchaser) who purchases a ticket through the Service Provider's system: specifically, their rights and obligations, liability relationships, and the conditions for purchasing tickets.

2. The Service Provider operates a system for selling tickets to various cultural events, including an online ticket sales interface (hereinafter: System), which provides the Ticket Purchaser with access to tickets purchased for cultural events.
The service does not qualify as a service subject to authorization. The name of the ticket sales interface: ticat.hu.

2.1. Cultural events are typically held in Hungary, organized by a natural or legal person undertaking the organization of the cultural event (hereinafter: Event) (hereinafter: Event Organizer).

2.2. The scope of these GTC extends to the Service Provider, the Ticket Purchaser, as well as the Event Organizer based on the contractual relationship established with the Service Provider, and every natural and legal person who uses any element of the System in any form.

2.3. These GTC do not extend to the legal relationships between the Event Organizer and the Ticket Purchaser, the conditions of which are contained in separate contracts or regulations found on the Event Organizer's official website.

3. The Ticket Purchaser uses the ticket sales service through the System.
The Ticket Purchaser accepts the provisions of these GTC by registering combined with a purchase on the ticket sales interface (or by purchasing a ticket at the venue of an Event Organizer using the System).

3.1. The establishment of the legal relationship between the Ticket Purchaser and the Service Provider is verified by electronically saved purchase data, which the Service Provider stores in the manner determined by the relevant legislation.
The concluded contract does not qualify as a written contract.

3.2. The Ticket Purchaser declares that they have become acquainted with the conditions set forth in these GTC and accepted them as binding upon themselves, and furthermore consented to the processing of their data necessary for using the Service within the scope defined in the GTC and the Service Provider's Privacy Policy.

3.3. The Ticket Purchaser acknowledges that the Service Provider is entitled to unilaterally modify the GTC, provided that it publishes information about the changes on the ticket sales interface.

II. LIABILITY CONDITIONS

1. These GTC state that the Service Provider does not qualify as the organizer or co-organizer of the Event or a party actively participating in the organization or execution; therefore, the Service Provider excludes its liability for damages potentially arising from the cancellation of the Event or its improper organization (including e.g.: cancellation, program changes, modification of dates, etc.).

2. These GTC state that the Service Provider's activity and liability are limited exclusively to the operation of the system and the sale of entry tickets, for the smooth operation of which the Service Provider does its utmost as expected.

3. These GTC state that regarding the execution of the event, the Ticket Purchaser enters into a service legal relationship only with the Event Organizer, which contractual relationship is established by the purchase of the entry ticket.

3.1. The Ticket Purchaser recognizes the rules of the House Rules and GTC available on the Event Organizer's website as binding upon themselves; consequently, and in the event of their violation, they may not pursue compensation claims against the Service Provider.

4. In the event of the transfer of entry tickets generated by the System, the new ticket holder acknowledges the GTC of the Service Provider and the house rules of the Event and recognizes them as binding upon themselves.

5. The Service Provider excludes liability for all damages caused by the Ticket Purchaser, the Event Organizer, or a third party's breach of contract or unlawful activity or omission.

6. The Service Provider is liable only for damages caused by intentional or grossly negligent errors attributable to it, the extent of which liability may not exceed the value of the purchase transaction.

7. The Ticket Purchaser acknowledges that the Service Provider assumes no responsibility for information and content uploaded to the Service's website by the Event Organizer.

8. The Ticket Purchaser acknowledges that the Service Provider is furthermore not responsible for any damage or misuse that occurs during or as a result of online payment, with particular regard to direct or indirect damages arising from data loss, system usage, or temporary unavailability.

III. UNAUTHORIZED DATA USE, REGISTRATION, NEWSLETTER, SELF-PRINTED TICKET

1. The Service Provider undertakes to take all measures expected of it to protect the data generated during registration and ticket purchase, furthermore, to process all personal data that comes to its knowledge in accordance with the provisions of data protection legislation, with particular regard to Act CXII of 2011 on the Right to Informational Self-Determination and on Freedom of Information (Info Act), as well as Act CVIII of 2001 on certain issues of electronic commerce services and information society services, and the rules of Government Decree 45/2014 (II. 26.); Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of personal data (GDPR). Based on all this, the Service Provider has its own Privacy Policy.

2. The Ticket Purchaser undertakes to immediately notify the Service Provider in case of any unauthorized use of their data or if security is breached in any other way.
The Service Provider is not liable for damages resulting from the storage of the password on the Ticket Purchaser's side or from providing the Ticket Purchaser name and password to a third party.

2.1. The Ticket Purchaser is entitled to delete their registration at any time with a message containing a deletion request sent to the support@ticat.hu email address.

2.2. The Ticket Purchaser's data will be removed from the system immediately following the deletion request, except for those affected by the retention and recording obligations set forth in the privacy statement; furthermore, the deletion does not affect the retention of data and documents related to already placed orders and does not result in the deletion of these data.

3. The Service Provider may delete the registration of Ticket Purchasers who, in its judgment, abuse any other person's name, likeness, email address, or other personal data or right.

4. The Ticket Purchaser is obliged to update changes in their data in the data recorded in the System.
The Ticket Purchaser bears exclusive responsibility for damages resulting from the failure to fulfill this obligation.

5. If the Ticket Purchaser subscribes to the Service Provider's newsletter, the Service Provider may send a newsletter to the Ticket Purchaser at pre-determined intervals.
In the case of Ticket Purchasers who have subscribed to the Newsletter, the Service Provider is entitled to recommend events to the Ticket Purchaser based on the interest group likely inferred from previous purchases.
The Ticket Purchaser may block the use of data for such marketing purposes, which do not affect the conditions of the Service, by unsubscribing.

6. The Ticket Purchaser may download self-printed tickets themselves in PDF format through their own Ticket Purchaser page after a successful purchase, and may print them if required.
Purchased tickets can still be found in the Ticket Purchaser's own account on the ticket sales interface after printing/downloading.

6.1. Responsibility for consequences and damages resulting from the loss, theft, faulty printing, or copying of self-printed tickets lies exclusively with the Ticket Purchaser.

6.2. The Event Organizer may electronically check the barcode on the E-ticket at the venue of the Event, and invalidates it immediately after checking.
Entry is based on the first validation. Thus, the first ticket that the Event Organizer's entry system accepted with the specified data is valid.
Every further entry attempt will be invalid and therefore unsuccessful; entry may be refused to its presenter regardless of whether the person presenting the invalid ticket is identical to the person who originally purchased the E-ticket.

7. Entry tickets may contain digital and analog security solutions that protect the entry tickets against counterfeiting.
In case of damage to these solutions, the Event Organizer may refuse entry to the Event to the presenter of the entry ticket, or may call upon the presenter of the entry ticket to leave the territory of the Event.
The Ticket Purchaser may not pursue damage claims against the Service Provider due to a ban based on such reasoning.

7.1. The Service Provider is entitled to suspend the Service partially or in its entirety for the purpose of maintenance of the Service or the related website, or due to other security considerations, without any prior information or notification.

IV. THE TICKET PURCHASE PROCESS

1. By clicking the 'Payment' button, the Ticket Purchaser accepts the rules of these GTC; they recognize its provisions as binding upon themselves.

2. Detailed rules regarding the ticket purchase process and the use of the QR code entitling entry to the event are contained in the annex to this document.

3. Payment, as a general rule, occurs through the SimplePay system of SimplePay Zrt.
The System offers a different banking provider in exceptional cases and clearly indicated.

4. Ticket purchase happens practically immediately, in real-time, after the payment has successfully occurred.
The Ticket Purchaser receives the PDF file containing the QR code in the purchase confirmation email, which they can download and print, but can also find by logging into their purchaser account (if they created one).

5. During the purchase, the Ticket Purchaser has the opportunity to modify or delete the content of the order on the site.
If correction of data is necessary, they may do so without limit until they have clicked the 'Payment' button.

6. If the Ticket Purchaser does not receive the purchased entry tickets within a few minutes following the purchase, the reason for this is presumably a technical error or extreme load on the ticket system.
In the latter case, up to 1-3 hours may elapse until the sending of the email about the ticket purchase. According to the guidance of these GTC, in such cases, the Ticket Purchaser should not initiate a repetition of the transaction but should report the problem at the support@ticat.hu email address.
If the payment was successful (the payment amount was deducted on the bank side), the ticket purchase is considered completed and valid, regardless of the arrival of the tickets by email. The Service Provider is obliged to remedy problems and/or technical errors falling within its own scope of responsibility within the shortest expected time.
If the technical error occurs on the bank side or during the operation of another service enabling the Service, the Service Provider is obliged to provide information about the error that came to its knowledge on its own communication interfaces or in an email to the Ticket Purchaser or in the System messages without delay.

7. By clicking the Payment button, the Ticket Purchaser acknowledges and accepts that the following personal data stored in the user database of https://ticat.hu by the data controller TICAT Kft. (1065 Bp. Nagymező u. 3.) will be transferred to SimplePay Zrt., as a data processor.

V. RULES REGARDING EVENT CANCELLATION

1. In case of cancellation or potential failure of the Event for any reason, the Service Provider does its best to deliver the information received from the Event Organizer to the ticket purchasers; however, it is not responsible for the correctness or authenticity of the information published by the Event Organizer.

2. The Service Provider undertakes to immediately publish data regarding ticket redemption on its website as soon as it has received them in official form from the Event Organizer.

3. The Service Provider does everything expected of it to facilitate the redemption of tickets.
Announcements regarding the potential cancellation of the Event must contain all major data regarding the cancelled Event, the fact and reasoning for the cancellation, and the method for redeeming entry tickets.
The Event Organizer is obliged to publish the fact of redemption and its process on its own website and the Event's website as well.

4. The Ticket Purchaser acknowledges that in case of Event cancellation, the Event Organizer decides on the process, location, and deadline for ticket redemption, and the Event Organizer is responsible for its implementation.

5. In the absence of an assignment regarding the redemption of entry tickets arriving from the Event Organizer, the Service Provider cannot be compelled to redeem entry tickets or to refund the purchase price of entry tickets.

6. The Ticket Purchaser acknowledges that there is no way to redeem entry tickets in cases other than the cancellation of the Event.

7. The Event must be considered properly held even with interruption due to weather, premature completion, or delayed start, if more than half of the Event was properly held, or if the start of the Event is delayed by less than 50% compared to the planned length of the Event, or if it must be suspended for less than 25% of the time.

7.1. The Event Organizer is entitled to determine different rules regarding rain days and partially held Events.

8. If the event is cancelled as a consequence of force majeure or other unforeseen and unavoidable obstacles, the Event Organizer bears no responsibility for any loss or damage that arose as a result of these events.

VI. RIGHT OF WITHDRAWAL

1. Based on Section 1 (4) b) of Government Decree 45/2014. (II. 26.), the Ticket Purchaser is not entitled to a right of withdrawal following online payment.
The Service Provider is not in a position to redeem the entry ticket, nor to refund the value of the purchase differently from the Event Organizer's instructions.

2. In case of cancellation of the Event for any reason, the primary party obligated for the redemption of the entry ticket is the Event Organizer.

VII. PROVISIONS ON COPYRIGHT

VIII. EQUITABLE CONSIDERATION OF COMPLAINTS ARISING DURING TICKET SALES

1. The Service Provider's registered seat, the place of complaint handling, and its electronic mail address can be found in point I of the GTC.

2. The Ticket Purchaser may communicate in writing their complaint regarding the Service Provider's behavior, activity, or omission directly related to the sale of the ticket.
The Service Provider remedies the complaint immediately if possible. If the Ticket Purchaser does not agree with the handling of the complaint, or if the immediate investigation of the complaint is not possible, the Service Provider is obliged to immediately take minutes of the complaint and its position related to it.

3. In consumer protection administrative authority matters, the consumer protection inspectorates of the capital and county government offices act in the first instance with county jurisdiction, and the National Consumer Protection Authority acts in the second instance with national jurisdiction.
Jurisdiction is established by the consumer's residence, the enterprise's registered seat, site, as well as the place where the infringement was committed.
The application may be submitted at any competent inspectorate.

4. The out-of-court settlement of disputed matters (consumer legal dispute) between the Ticket Purchaser and the Service Provider related to the quality and safety of the service, furthermore the conclusion and fulfillment of the contract between the parties, falls within the competence of the conciliation body.
The conciliation body is an independent body operating alongside the county (capital) chambers of commerce and industry.
